1. Introduction
Welcome to The Uncommon Witness Photography. By accessing this website and booking our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use this website or book our services.
2. Definitions
- “Photographer” refers to The Uncommon Witness Photography.
- “Client” refers to the person making the booking.
- “Services” refers to photography services provided by the Photographer.
- “Images” refers to all photographs produced during the booking.
3. Booking & Payment
3.1 Booking Confirmation
A booking is only confirmed once:
- A signed contract has been received (where applicable).
- The required booking fee/deposit has been paid.
3.2 Payment
- The remaining balance must be paid by the agreed due date stated on your invoice.
- Failure to pay may result in cancellation of services.
3.3 Deposit
- Deposits are non-refundable and secure the Photographer’s availability for your date.
- The deposit amount will be deducted from the final balance.
4. Cancellation & Rescheduling
4.1 Client Cancellation
If the Client cancels:
- Deposits remain non-refundable.
- Any additional payments may be refunded at the Photographer’s discretion, depending on notice given and expenses incurred.
4.2 Rescheduling
- Requests to reschedule will be considered subject to availability.
- Deposits may be transferred to a new date if sufficient notice is provided and the Photographer is available.
4.3 Photographer Cancellation
In the unlikely event that the Photographer is unable to attend due to illness, injury, emergency, or circumstances beyond their control:
- Every effort will be made to find a suitable replacement photographer.
- If no replacement can be found, all monies paid will be refunded in full.
- Liability is limited to the total amount paid by the Client.
5. Coverage & Cooperation
- The Client is responsible for obtaining permission for photography at the chosen venue.
- The Photographer is not responsible for missed images due to lateness, venue restrictions, weather conditions, or lack of cooperation from guests.
- A suitable meal and refreshments are appreciated for bookings exceeding six consecutive hours but are not mandatory.
6. Artistic Style
The Client acknowledges that:
- They are familiar with the Photographer’s style and portfolio.
- Editing style, composition, and creative decisions remain at the Photographer’s discretion.
- RAW/unedited images will not be supplied unless agreed with the Photographer.
7. Delivery of Images
- Sneak peek images may be provided where included in the package.
- Final edited galleries are typically delivered within the timeframe stated in the package description or contract.
- Delivery times may vary during peak seasons.
8. Image Storage
- Clients are advised to download and back up their images immediately upon delivery.
- The Photographer will endeavour to retain copies of images for up to 12 months but cannot guarantee long-term storage.
9. Copyright
All photographs remain the copyright of The Uncommon Witness Photography under the Copyright, Designs and Patents Act 1988.
The Photographer retains all rights to:
- Use images for portfolio purposes.
- Display images on websites, social media, blogs, competitions, and promotional materials.
10. Client Usage Rights
Clients receive a personal-use licence allowing them to:
- Download and share images.
- Print images for personal use.
- Share images on social media with appropriate credit where possible.
Clients may not:
- Sell images.
- Alter images significantly.
- Submit images for commercial use without written permission.
11. Social Media
The Photographer may share selected images on social media and marketing platforms unless otherwise agreed in writing before the event.
Clients who require complete privacy should notify the Photographer prior to booking.
12. Privacy & Data Protection
The Photographer complies with applicable UK data protection laws.
Personal information collected may include:
- Names
- Contact details
- Event information
This information will only be used:
- To provide photography services.
- To communicate regarding bookings.
- To meet legal and accounting obligations.
Personal data will never be sold to third parties.
13. Limitation of Liability
While every care is taken in the performance of services:
- The Photographer shall not be liable for circumstances beyond their control.
- Liability is limited to the value of the booking.
- The Photographer is not responsible for image loss caused by equipment failure, venue restrictions, severe weather, acts of God, or third-party interference.
14. Website Content
All website content, including text, photographs, logos, and branding, is owned by The Uncommon Witness Photography and may not be copied, reproduced, or distributed without written permission.
15. Complaints
Any concerns should be raised in writing within 14 days of receiving your images. The Photographer will make every reasonable effort to resolve concerns promptly and professionally.
16. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
