Introduction<\/h3><p class=\"isSelectedEnd\">Welcome to The Uncommon Witness Photography. By accessing this website and booking our services, you agree to be bound by these Terms &amp; Conditions. If you do not agree with any part of these terms, please do not use this website or book our services.<\/p><h3>2. Definitions<\/h3><ul data-spread=\"false\"><li><strong>&#8220;Photographer&#8221;<\/strong> refers to The Uncommon Witness Photography.<\/li><li><strong>&#8220;Client&#8221;<\/strong> refers to the person making the booking.<\/li><li><strong>&#8220;Services&#8221;<\/strong> refers to photography services provided by the Photographer.<\/li><li><strong>&#8220;Images&#8221;<\/strong> refers to all photographs produced during the booking.<\/li><\/ul><h3>3. Booking &amp; Payment<\/h3><h4>3.1 Booking Confirmation<\/h4><p class=\"isSelectedEnd\">A booking is only confirmed once:<\/p><ul data-spread=\"false\"><li>A signed contract has been received (where applicable).<\/li><li>The required booking fee\/deposit has been paid.<\/li><\/ul><h4>3.2 Payment<\/h4><ul data-spread=\"false\"><li>The remaining balance must be paid by the agreed due date stated on your invoice.<\/li><li>Failure to pay may result in cancellation of services.<\/li><\/ul><h4>3.3 Deposit<\/h4><ul data-spread=\"false\"><li>Deposits are non-refundable and secure the Photographer&#8217;s availability for your date.<\/li><li>The deposit amount will be deducted from the final balance.<\/li><\/ul><h3>4. Cancellation &amp; Rescheduling<\/h3><h4>4.1 Client Cancellation<\/h4><p class=\"isSelectedEnd\">If the Client cancels:<\/p><ul data-spread=\"false\"><li>Deposits remain non-refundable.<\/li><li>Any additional payments may be refunded at the Photographer&#8217;s discretion, depending on notice given and expenses incurred.<\/li><\/ul><h4>4.2 Rescheduling<\/h4><ul data-spread=\"false\"><li>Requests to reschedule will be considered subject to availability.<\/li><li>Deposits may be transferred to a new date if sufficient notice is provided and the Photographer is available.<\/li><\/ul><h4>4.3 Photographer Cancellation<\/h4><p class=\"isSelectedEnd\">In the unlikely event that the Photographer is unable to attend due to illness, injury, emergency, or circumstances beyond their control:<\/p><ul data-spread=\"false\"><li>Every effort will be made to find a suitable replacement photographer.<\/li><li>If no replacement can be found, all monies paid will be refunded in full.<\/li><li>Liability is limited to the total amount paid by the Client.<\/li><\/ul><h3>5. Coverage &amp; Cooperation<\/h3><ul data-spread=\"false\"><li>The Client is responsible for obtaining permission for photography at the chosen venue.<\/li><li>The Photographer is not responsible for missed images due to lateness, venue restrictions, weather conditions, or lack of cooperation from guests.<\/li><li>A suitable meal and refreshments are appreciated for bookings exceeding six consecutive hours but are not mandatory.<\/li><\/ul><h3>6. Artistic Style<\/h3><p class=\"isSelectedEnd\">The Client acknowledges that:<\/p><ul data-spread=\"false\"><li>They are familiar with the Photographer&#8217;s style and portfolio.<\/li><li>Editing style, composition, and creative decisions remain at the Photographer&#8217;s discretion.<\/li><li>RAW\/unedited images will not be supplied unless agreed with the Photographer.<\/li><\/ul><h3>7. Delivery of Images<\/h3><ul data-spread=\"false\"><li>Sneak peek images may be provided where included in the package.<\/li><li>Final edited galleries are typically delivered within the timeframe stated in the package description or contract.<\/li><li>Delivery times may vary during peak seasons.<\/li><\/ul><h3>8. Image Storage<\/h3><ul data-spread=\"false\"><li>Clients are advised to download and back up their images immediately upon delivery.<\/li><li>The Photographer will endeavour to retain copies of images for up to 12 months but cannot guarantee long-term storage.<\/li><\/ul><h3>9. Copyright<\/h3><p class=\"isSelectedEnd\">All photographs remain the copyright of The Uncommon Witness Photography under the Copyright, Designs and Patents Act 1988.<\/p><p class=\"isSelectedEnd\">The Photographer retains all rights to:<\/p><ul data-spread=\"false\"><li>Use images for portfolio purposes.<\/li><li>Display images on websites, social media, blogs, competitions, and promotional materials.<\/li><\/ul><h3>10. Client Usage Rights<\/h3><p class=\"isSelectedEnd\">Clients receive a personal-use licence allowing them to:<\/p><ul data-spread=\"false\"><li>Download and share images.<\/li><li>Print images for personal use.<\/li><li>Share images on social media with appropriate credit where possible.<\/li><\/ul><p class=\"isSelectedEnd\">Clients may not:<\/p><ul data-spread=\"false\"><li>Sell images.<\/li><li>Alter images significantly.<\/li><li>Submit images for commercial use without written permission.<\/li><\/ul><h3>11. Social Media<\/h3><p class=\"isSelectedEnd\">The Photographer may share selected images on social media and marketing platforms unless otherwise agreed in writing before the event.<\/p><p class=\"isSelectedEnd\">Clients who require complete privacy should notify the Photographer prior to booking.<\/p><h3>12. Privacy &amp; Data Protection<\/h3><p class=\"isSelectedEnd\">The Photographer complies with applicable UK data protection laws.<\/p><p class=\"isSelectedEnd\">Personal information collected may include:<\/p><ul data-spread=\"false\"><li>Names<\/li><li>Contact details<\/li><li>Event information<\/li><\/ul><p class=\"isSelectedEnd\">This information will only be used:<\/p><ul data-spread=\"false\"><li>To provide photography services.<\/li><li>To communicate regarding bookings.<\/li><li>To meet legal and accounting obligations.<\/li><\/ul><p class=\"isSelectedEnd\">Personal data will never be sold to third parties.<\/p><h3>13. Limitation of Liability<\/h3><p class=\"isSelectedEnd\">While every care is taken in the performance of services:<\/p><ul data-spread=\"false\"><li>The Photographer shall not be liable for circumstances beyond their control.<\/li><li>Liability is limited to the value of the booking.<\/li><li>The Photographer is not responsible for image loss caused by equipment failure, venue restrictions, severe weather, acts of God, or third-party interference.<\/li><\/ul><h3>14. Website Content<\/h3><p class=\"isSelectedEnd\">All website content, including text, photographs, logos, and branding, is owned by The Uncommon Witness Photography and may not be copied, reproduced, or distributed without written permission.<\/p><h3>15. Complaints<\/h3><p class=\"isSelectedEnd\">Any concerns should be raised in writing within 14 days of receiving your images. The Photographer will make every reasonable effort to resolve concerns promptly and professionally.<\/p><h3>16. Governing Law<\/h3><p class=\"isSelectedEnd\">These Terms &amp; Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.<\/p><h3>17.
